Zophee's Terms of Service 2025.7.4

We take pride in making things simple, and that includes this section. Terms of Service are usually dry, but we've written ours in plain language to help you understand exactly how Zophee works and what you're agreeing to.

Effective Date: July 1st, 2025.

Welcome to Zophee!

By using our app, you agree to these Terms of Service. If you do not agree, please do not use the app.


1. Who Can Use Zophee

You must be at least 18 years old to use Zophee. This helps ensure compliance with data protection laws and protects younger users from providing personal data without appropriate consent. If you are under 18, you may only use the app through an institutional account managed by a parent, school, or employer.


2. Your Account, Your Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.


3. Not a Medical App

Zophee offers tools for relaxation, focus, and mental clarity. It is not a medical or therapeutic service. If you are experiencing a mental health crisis, please contact a healthcare professional immediately or call your local emergency number (such as 911 in the U.S.).

4. Subscriptions and Billing

Zophee Premium subscriptions renew automatically unless canceled at least 24 hours before the renewal date. You may cancel your subscription through the app store used to purchase the subscription.

Please note: all billing, subscription management, and refund decisions are handled entirely by Apple or Google, depending on your platform. Zophee does not have access to your payment information or the ability to issue refunds directly. We'll always help point you in the right direction if you have questions, but these matters are ultimately governed by the policies of the app store you use.


5. Use of the App

You agree to use Zophee only for lawful purposes. Do not attempt to reverse engineer, disrupt, or misuse the app.


6. License to Use the App

We're giving you a personal, non-transferable, revocable license to use Zophee for your own non-commercial purposes. This license doesn't give you ownership of the content, app, or brand.


7. User Content

If you provide feedback or submit content to Zophee, you grant us a non-exclusive, royalty- free license to use it to improve our services.


8. Dispute Resolution

Any legal dispute between you and Zophee will be resolved through individual arbitration, not class actions. You can opt out of this within 30 days of agreeing by emailing us athello@zophee.app

9. Modifications to the Service

We may update, modify, or discontinue the app at any time. Where feasible, we'll let you know in advance.


10. Termination

We reserve the right to suspend or terminate accounts that violate these Terms.


11. Updates to Terms

We may update these Terms periodically. If we make significant changes, we will notify you. Continued use of Zophee means you accept the new terms.


12. Protecting Our Content

Everything inside Zophee (the audio, the structure, the visuals, and the wording) belongs to Zerene App LLC. You can't resell, repackage, or redistribute it as part of your own course, product, or content bundle without our written permission.


13. No Bots or AI Scraping

Zophee wasn't built to train other apps. You can't use bots, scraping tools, or AI training systems to copy or extract our content. That includes everything from our voiceovers to our visuals.


14. Third-Party Services

Zophee relies on trusted third parties (like cloud hosting and analytics tools) to operate. We're not responsible for their services or any downtime or issues they may cause.


15. Limitation of Liability

Zophee is provided "as is." We don't guarantee specific outcomes or results. To the fullest extent allowed by law, we're not liable for any damages that come from using or not being able to use the app.

16. Indemnification

If you misuse Zophee or violate these Terms and that results in legal claims or damages, you agree to cover our costs and losses.


17. DMCA / Copyright Complaints

If you believe something in Zophee infringes your copyright, email us at hello@zophee.app with the details and we'll review it promptly.

19. Privacy Policy

By using Zophee, you also agree to our Privacy Policy. It explains how we collect, use, and protect your personal data. If anything in these Terms conflicts with the Privacy Policy, the Terms will take priority.


20. Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles.

If you're located outside the U.S., you may still have rights under the consumer protection laws of your own country. These Terms do not limit any rights that can't legally be waived.


21. Compliance with Laws

You agree to use Zophee in accordance with all applicable laws and regulations, including any export control or sanctions laws. You may not use the app if you're on any U.S. government restricted list or located in a country that is subject to U.S. sanctions.

22. App Store Terms

These Terms are between you and Zophee App LLC—not Apple, Google, or any other app store provider.

Apple and Google are not responsible for the app, and they don't provide any support, guarantees, or warranties related to it.

Apple (and its subsidiaries) are third-party beneficiaries of these Terms and may enforce them if needed.


23. Entire Agreement

These Terms, along with our Privacy Policy, are the complete agreement between you and Zophee. They replace any earlier written or verbal agreements.


24. Severability

If any part of these Terms is found to be invalid or unenforceable, the rest will still apply.


25. California Consumer Notice

Under California Civil Code §1789.3, California users may contact the Complaint Assistance Unit of the Division of Consumer Services, Department of Consumer Affairs at 1625 North Market Blvd., Suite N-112, Sacramento, CA 95834, or (800) 952-5210.
